1. Acceptance of Terms

By accessing or using Marketync ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Platform.

2. Description of Service

Marketync is a multi-channel marketing automation platform that provides:

  • WhatsApp Business API messaging and campaign management
  • Email marketing and campaign management
  • Contact management and segmentation
  • Template creation and management
  • Analytics and reporting
  • Team Inbox for live chat
  • Auto-reply and chatbot rules
  • Drip sequences and automation

3. Account Responsibilities

  • You must provide accurate account information
  • You are responsible for maintaining the security of your credentials
  • You must not share your account with unauthorized parties
  • You must immediately notify us of any unauthorized access

4. Acceptable Use

You agree NOT to use the Platform to:

  • Send spam, unsolicited messages, or violate anti-spam laws
  • Send messages to contacts who have not opted in
  • Distribute malware, phishing, or fraudulent content
  • Violate WhatsApp Business Policy or Meta Platform Terms
  • Harass, threaten, or harm any individual
  • Violate any applicable local, national, or international law

5. WhatsApp Business API Compliance

When using WhatsApp features, you agree to:

  • Comply with WhatsApp Business Policy and Commerce Policy
  • Only message contacts who have opted in to receive communications
  • Use approved message templates for business-initiated conversations
  • Respect the 24-hour customer service window for free-form messages
  • Not use the platform for prohibited content categories

6. Subscription and Billing

  • Plans are billed monthly or yearly as selected at the time of purchase
  • Meta's per-message fee for WhatsApp templates is separate and charged by Meta directly
  • You can upgrade or downgrade your plan at any time
  • Refunds are handled on a case-by-case basis within 7 days of payment

7. Data Ownership

  • You retain ownership of your contact data, templates, and campaign content
  • You grant us a limited license to process your data to provide the service
  • We do not claim ownership over your business data

8. Service Availability

  • We strive for high availability but do not guarantee 100% uptime
  • Message delivery depends on Meta/WhatsApp infrastructure
  • We are not liable for message delivery failures caused by Meta's systems

9. Limitation of Liability

To the maximum extent permitted by law, Marketync shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to lost profits, data loss, or business interruption.

10. Termination

  • You may terminate your account at any time by contacting support
  • We may suspend or terminate accounts that violate these terms
  • Upon termination, your data will be deleted as per our Privacy Policy

11. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of the Platform after changes constitutes acceptance of the new terms.
